  2. If you would like to become an authorized vendor/distributor of 
  3. JESTER SOFTWARE CO. Please write to us, international inquiries are welcome. 
  4. To help facilitate our approval process please send a copy of your current 
  5. catalog, or your statement of being an approved Association of Shareware 
  6. Profesionals (ASP) or Shareware Trade Association and Resources (STAR) vendor, 
  7. or send us your, or request our, vendor agreement. Please reply to our address 
  8. below.

  10. This VENDOR.DOC describes the only terms by which JESTER Games, Co.
  11. (P.O. Box 1151 Santa Clara CA 95460, )
  12. permit Commercial Distribution of this Program.
  13.  
  14. "Commercially distribute" means to distribute for money or other
  15. consideration.  It includes copying onto magnetic disks, CD-Roms
  16. or any other tangible medium now or subsequently known, and
  17. distribution by retail rack, direct mail, catalog, advertisement,
  18. or trade show.  It does *not* include distribution by any not-
  19. for-profit organization, by any hobby, user or computer interest
  20. group to its members, or electronically by any BBS.

  22. "Program" means this Version 1.0 and its related files (including
  23. this one) distributed by us under the mark "GORE GALORE"
  24. (collectively, the "Trademark"), as it may be upgraded or
  25. otherwise modified from time-to-time.

  27. Distribution is "non-commercial" when for free, or by any not-for-
  28. profit corporation or tax exempt organization, or by hobby, user or
  29. computer interest group to its members, or by any BBS.

  31. A. OWNERSHIP:  Except to the extent expressly licensed by us, we
  32. have and reserve the exclusive copyright and other rights, title
  33. and interest to distribute the Program and all earlier versions
  34. of it, and the right to use the Trademark in connection with them.

  36. B.   DISTRIBUTION:  You may Commercially Distribute the Program,
  37.      under this License so long as you:
  38.  [1] Market it as shareware using "try before you buy" or similar words,
  39.  [2] Try to sell only the most current version of it,

  55. does not include any right to [1] sublicense or otherwise cause
  56. any copying or distribution of the Program by anyone else without
  57. our consent in writing, or [2] rent or lease the Program, or
  58. [3] sell it as part of any hardware or software package, or [4]
  59. bundle this program as an incentive for any other product.

  61. E. THE PROGRAM IS PROVIDED "AS-IS".  NO WARRANTIES OF ANY KIND,

  63. WE WILL PROVIDE NO REMEDY FOR INDIRECT, CONSEQUENTIAL, PUNITIVE

  69. by either us to the other.  If terminated by us by such notice, you

  73. the termination of this License.
